‘Pennsylvania Skill’ Games Operator Tells Host Locations It Will Turn Off Machines During Next Collection Round

The operator behind Pennsylvania’s dominant line of skill games, which have become commonplace in thousands of small businesses, says the machines will be turned off next month. The cabinets are the most common skill game across the commonwealth, accounting for the vast majority of the estimated 70,000 machines operating from Philadelphia to Pittsburgh. With the games set to become illegal slot machines on Oct. 14, when the Pennsylvania Supreme Court’s 120-day stay on its June ruling expires, Miele is updating host locations on how the next two weeks will play out. Games Will Be Turned Off Miele Manufacturing builds the Pennsylvania Skill cabinets through a licensing agreement with Georgia-based Pace-O-Matic (POM), which developed the game software. Miele then sells and leases the cabinets to operators, which handle installation, servicing, and collection duties. Miele additionally functions as an operator through its subsidiaries, including Miele Amusements and Pennsylvania Amusements. Miele’s operational divisions told host locations in Pennsylvania this week that during their next collections, the machines will be powered down. The owner of a chain of grocery stores who spoke with Casino.org said Miele did not say whether it plans to physically remove the machines. Miele did not respond to Casino.org’s request for comment. On Tuesday (Sept. 29), Pennsylvania Attorney General Dave Sunday said simply turning off the machines does not comply with the law. Powering off or unplugging machines is not sufficient to comply with the law. To be clear, a slot machine does not cease being a slot machine if it has simply been turned off, unplugged, or temporarily disabled, allowing it to be readily operated,” Sunday said. Sunday is encouraging businesses to contact their vendors and distributors to demand the removal of the skill games “to avoid law enforcement action.” The state’s top prosecutor said businesses that continue to host skill games from Oct. 14 forward are breaking the law and risk legal consequences. Legal Backstory Miele and POM unsuccessfully argued in state court that skill games aren’t gambling machines because their payout rates can be influenced by a player’s skill. The skill component primarily deals with memory-based bonus rounds. In “Follow Me,” the player is challenged to repeat a pattern that’s quickly shown on the screen. The Supreme Court, however, agreed with state prosecutors on their claim that the aptitude element is irrelevant. “Our General Assembly already has spoken clearly on this subject, particularly through a 2017 enactment that added new terms to the Gaming Act’s definition of a ‘slot machine,’ i.e., ‘skill slot machine,’ and ‘hybrid slot machine,’ which make abundantly clear that the ‘skill’ element of the subject devices is not legally significant. That is to say, as it concerns their unregulated operation in unlicensed facilities throughout Pennsylvania, it is not this Court that declares ‘skill games’ to be unlawful. Rather, it is the General Assembly that did so nearly a decade ago,” Justice David Wecht wrote in the majority opinion.
