Australian customers file class action lawsuit against Entain

The customers of Australian gambling companies Neds and Ladbrokes have set in motion a class action lawsuit against the operator of both companies, Entain, for compensation against lost live bets that the customers claim do not comply with the Australian legislation. In Australia, live betting is restricted in a variety of ways. Despite the ability to place bets once the sporting events have started over the phone, live betting requires communication of betting information during the call alone. The dispute is a result of how the bets were made. Entain utilizes a service dubbed “Fast Code” which allows customers to choose their live bet on the site or the app and take the generated code of eligibility provided by the system to the bookmaker over the phone. The plaintiffs believe that some betting information has been omitted in this case and thus the law is not being satisfied. In December 2023, after a year-long review, the Australian regulator ACMA concluded that the use of such codes by several operators violated the law. According to the regulator, bet information and confirmation must be fully communicated during a telephone conversation. Entain denies that the service is illegal and plans to uphold its position in court. The company has also lodged a counterclaim stating that if the court brings an order to reimburse customers for lost bets, Entain wants to recover any winnings previously paid to them.
