Federal Appellate Judge Adriana Pileggi of Brazil’s Federal Regional Court of the 3rd Region (TRF-3) has granted interim relief to CDA Gaming Ltda. which allows it to resume operations and suspending the effects of Provisional Measure No. 1,394/2026 in its case. The decision was issued on November 3. It allows CDA Gaming to resume its licensed activities while the court considers the writ of mandamus filed by the company at first instance. CDA Gaming operates the Casa de Apostas, Betsul and Jogo Online brands. The company received authorisation from the Secretariat of Prizes and Bets of the Ministry of Finance (SPA/MF) under Ordinance SPA/MF No. 255/2025, which granted it permission to operate until December 2029. For the license CDA Gaming paid R$30m based on the court rulings. According to Brazilian legal news website, Lei em Campo, Judge Pileggi concluded that making the enterprises stop functioning in such a limited timeframe can result in undue financial losses as well as contradict such fundamental principles as legal certainty, reasonableness and proportionality. The judgment stated that the provisional regulations do not stipulate costs reimbursement or compensation for the operators subjected to the measure. The court also paid attention to the sanctions indicated by the provisional guidelines, which also foresee about $200,000 fine for non-compliance with its provisions. The interim relief allows CDA Gaming’s domains to resume in the country and the operational, financial and payment services required to conduct its licensed activities. The ruling applies exclusively to CDA Gaming and does not extend to other betting operators affected by the provisional measure. CDA Gaming must continue to comply with applicable regulatory requirements and remain subject to government oversight.
