Prediction platform Kalshi has permanently banned George Santos, a former US congressman, from trading on its platform. This decision follows an in-depth investigation and is the latest in a series of controversies surrounding Santos. It also aligns with a renewed push by Kalshi and the Commodity Futures Trading Commission (CFTC) to crack down on insider trading and protect the integrity of prediction markets. Santos Previously Settled with the CFTC Kalshi’s action against Santos primarily centers on the former congressman’s bets relating to his own attendance at the State of the Union address. Initially, Santos posted a video on social media, confirming his attendance. However, he later posted another clip on X, claiming that he had missed his flight. In the meantime, he had allegedly placed bets on Kalshi, capitalizing on his sudden absence. This seemingly blatant case of insider trading sparked a federal investigation. The CFTC ultimately agreed to a settlement, with Santos paying a rather modest $35,000. Critically, the former congressman did not face criminal charges, even though his actions constituted insider trading. The CFTC seems to prefer this approach, as it also agreed to settle with a teleprompter operator for President Trump in a similar case. Such a lax approach seems rather baffling, given the brazenness of the offenses and the CFTC’s claims that it would crack down on insider trading. In April, the federal regulator stressed it would focus on policing fraud, abuse, and manipulation. David Miller, the CFTC’s director of enforcement, noted that the agency would aggressively prosecute trades with misappropriated information. Insider Trading Is a Growing Concern While the CFTC has been willing to settle for a financial fine, Kalshi has been far stricter regarding Santos. The company’s own compliance team also investigated the case and concluded that the former congressman’s activity showed signs of insider trading, leading to a lifetime ban. It is unclear whether Santos can still use other regulated prediction platforms, such as Polymarket. Hey Kalshi, thanks for the lifetime ban from your gambling platform. In 2024, he pleaded guilty to fraud and identity theft and was sentenced to seven years behind bars. However, he was pardoned by Trump just three months into his sentence. The reasoning behind the President’s clemency was that Santos had always voted Republican and publicly supported Trump. Despite this newest ban, insider trading remains a persistent issue in prediction markets. By August, Kalshi and Polymarket had flagged over 100 cases involving potential insider trading in 2026. Unfortunately, a lack of staff and budget cuts at the CFTC mean that federal probes into these offenses are going at a glacial pace, leaving platforms to fend for themselves.
